Terms of use
The terms, in plain words
These terms cover the Mawmaw’s app for iPhone and Android and the website at mawmawsrecipes.com, including the pages that show a shared recipe (together, “the service”). By using the service you agree to them. If you don’t, please don’t use it. Our privacy policy says what leaves your phone and what never does; it is part of these terms.
Who we are
Mawmaw’s is made and run by Clear Blue Design LLC, a Louisiana limited liability company (“we”, “us”). You can reach us at hello@mawmawsrecipes.com.
Using the app
We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own cooking and for sharing recipes with the people you choose. The app and the service, apart from your content, belong to us and our licensors. The app is distributed through the App Store and Google Play, and their terms apply to your download as well.
Your content is yours
The recipes, photos, videos and names you put into the app are yours, and stay yours. We don’t claim any rights in them, and we don’t have a copy of them except as the privacy policy describes.
You are responsible for what you add and what you share: for having the right to use a recipe, a photo or a page you read in, and for having the right to pass it on to the people you share it with. Don’t share anything unlawful, or anything that belongs to someone else without their permission. When you share a recipe, you are giving the people who receive it a copy to keep, cook and share on in turn.
The AI can make mistakes
A recipe is read in by an AI, from a photo, a page, a file, a link or text, and the chat that follows is with an AI. It is good at this, and it still makes mistakes: a smudged amount, a temperature in the wrong unit, a step it misread, a time it guessed. Always check the amounts, the times and the temperatures against the original before you cook, and especially where food safety is involved: cooking temperatures for meat, eggs and seafood, canning and preserving, fermentation, and anything else that can make someone ill when it goes wrong.
Allergies are yours to check. The app may miss an ingredient, misname one, or not know what a prepared product contains. Never rely on it to decide whether a dish is safe for someone with an allergy or a dietary restriction.
A cover painted by AI is a picture, not a photograph of the dish, and is labelled as such.
Timers, alarms and notifications are aids
Cook mode’s timers, alarms, Live Activities and notifications are there to help you keep time. They depend on your phone’s settings, its battery, the operating system and on the app being allowed to run; any of these can delay or silence them. Never leave cooking unattended because a timer is running, and never rely on the app for anything where a missed alarm could cause harm. We are not liable for the outcome of your cooking: a burnt pan, a dish that didn’t set, or anything worse.
Fair use
Reading recipes in and sharing them by link use our servers and an AI provider, which cost money, so each installation has daily limits on how many recipes it can read in and share. The limits are set so that a household never meets them. Don’t try to get round them.
Don’t abuse the service: no automated use, scraping or bulk requests, no attempts to break into, overload or interfere with it, no reverse engineering of the service or its protocols except where the law allows it regardless of this term, and no use of it for anything unlawful. We may limit or block an installation that does any of these.
Shared links
A link you share can be stopped by you at any time, and stops when you delete the recipe. Once stopped, it no longer opens, for anyone. A recipe that someone has already opened or saved from your link stays with them, as a copy you gave them. The people you share with are responsible for what they do with it, as you are for what you share.
The service may change or end
We may change the app and the service, add or remove features, or stop running parts of it, including the servers that read recipes in and serve shared links. Your recipes don’t depend on us: they are on your phone and in your own cloud account, and the backup files in your iCloud Drive stay yours whatever happens to the service. We may also change these terms; the current version is always at mawmawsrecipes.com/terms with its date, and using the service after a change means you accept it.
No warranty
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent permitted by law. We do not promise that the service will be uninterrupted, error-free or secure, or that a recipe will be read in correctly.
Limitation of liability
To the fullest extent permitted by law, Clear Blue Design LLC and the people who work on Mawmaw’s are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, recipes, profits or goodwill, arising from your use of the service or your inability to use it, however caused, even if we were told it could happen. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim, or, if you paid nothing, to one hundred US dollars. Some places do not allow some of these limits, in which case they apply to you only as far as the law allows.
Governing law
These terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict-of-law rules. Any dispute that can’t be settled by writing to us first will be heard in the state or federal courts located in Louisiana, and you agree to their jurisdiction. If a part of these terms is found unenforceable, the rest stays in force.
